Bracelet label Rastaclat is the latest brand to be targeted by OFF-WHITE for using red tags on its jewelry and quotation marks around the word “shoelaces.” The bracelets, which retail at $18, are also sold under the name “Off-Clat” and “Off-Clat c/o Rastaclat” on various retail sites including Amazon, Zumiez, and The Finish Line.
According to the report, OFF-WHITE filed the case against Rastaclat in Los Angeles this Monday and it alleges that the products violate OFF-WHITE’s exclusive rights.
The Fashion Law points out that while OFF-WHITE does not have a federal registration for design elements stated, its legal council asserts that the brand has amassed “significant common law trademark” on zip ties and quotation marks thanks to its promotional and distribution efforts, and general consumer buzz around the brand.
OFF-WHITE believes that consumers will be confused by Rastaclat’s $18 bracelets and could purchase them under the false illusion that they originate under Abloh’s design direction.
